Family law documents — divorce petitions, separation agreements, parenting plans, and custody orders — govern some of the most personal and consequential decisions people face. These documents determine where children will live, how time will be shared, how financial support will be provided, and how marital assets will be divided. The precision and completeness of these documents directly affects the lives of everyone involved, especially children.
In an uncontested divorce — where both parties agree on all issues including property division, spousal support, child custody, and child support — the process is primarily a document preparation and filing exercise. The parties have reached their agreement; what remains is expressing that agreement in the proper legal form, filing the appropriate court documents, and following the court's process to obtain a final divorce decree.
A separation agreement is the foundational document of an uncontested divorce. It records the complete agreement between the parties on every issue their divorce must resolve. A separation agreement that is missing critical provisions — that fails to address retirement accounts, that leaves real property transfers undefined, or that does not specify a holiday schedule — creates disputes that require court intervention to resolve.
The Juris Institute prepares family law documents for uncontested matters based entirely on the agreement you and your spouse or co-parent have reached. We do not advise you on what terms to agree to, negotiate on your behalf, or represent you in contested proceedings. For contested custody or divorce matters, you need a licensed family law attorney in your jurisdiction.
A parenting plan that simply states 'joint physical custody' is not complete. A comprehensive parenting plan addresses: the primary residence of each child, the regular weekly schedule, holiday and vacation schedule, school break schedule, the process for making major decisions (education, healthcare, extracurricular activities), communication between co-parents, relocation notice requirements, and the process for modifying the plan as children grow. The more detail the plan contains, the fewer disputes arise about what it means.
A prenuptial agreement (also called a premarital agreement) is a contract between prospective spouses that establishes the financial rights and obligations of each party in the event of divorce or death. Prenuptial agreements can protect pre-marital assets, establish how property acquired during the marriage will be treated, address spousal support rights, and protect business interests or inheritances. For the agreement to be enforceable, it must be entered into voluntarily, with full financial disclosure, and without fraud or duress.

Couples who have reached agreement on the terms of their divorce or custody arrangement need professional document preparation to put that agreement into the proper legal form.
When both spouses agree on how to divide property, handle support, and share parenting — the divorce is uncontested. The remaining need is properly prepared documents and guidance through the court's process. We prepare complete uncontested divorce document packages.
Unmarried parents who have agreed on how to share time with their children need a formal parenting plan for court approval. A detailed, well-drafted parenting plan reduces future conflict by answering questions before they arise.
Couples approaching marriage who want to establish clear financial boundaries benefit from a professionally prepared prenuptial agreement. Prenups are appropriate for any couple where one or both parties has pre-marital assets, business interests, or prior-relationship obligations to protect.
When life circumstances change — a parent relocates, income changes significantly, children's needs evolve — existing custody and support orders may need to be modified. We prepare agreed modification documents for court approval when both parties consent to the modification.
Some couples choose legal separation rather than divorce — maintaining certain benefits of marriage while establishing separate legal and financial lives. We prepare legal separation agreements and the documents required to formalize a legal separation in your state.
Individuals who represent themselves in uncontested divorce proceedings need properly prepared documents. Many courts require specific forms and formats. We prepare court-compliant divorce documents for pro se filers in all states.

Common Questions
What makes a divorce 'uncontested' and am I eligible?
An uncontested divorce is one in which both spouses agree on all issues that the divorce must resolve — property division, spousal support, child custody, child support, and debt allocation. If you and your spouse have reached agreement on all of these issues (or if there are no children and minimal property), you likely qualify for an uncontested divorce. If you disagree on any material issue, the divorce is contested and will require attorney representation and possibly a trial. The document preparation process for an uncontested divorce is significantly simpler and less expensive than contested litigation.
Does a separation agreement have to be approved by a court?
In most states, a separation agreement becomes binding between the parties as a contract once both parties sign it. For the agreement to be incorporated into the final divorce decree — which gives it the force of a court order and makes it enforceable by contempt — the court must review and approve it. Courts generally approve separation agreements that are fair and not contrary to public policy. For provisions related to child custody and support, courts apply an independent best-interest-of-the-child standard rather than simply deferring to the parties' agreement.
What is a QDRO and is it included in my divorce documents?
A Qualified Domestic Relations Order (QDRO) is a specialized court order that divides a retirement account (such as a 401(k) or pension) between divorcing spouses without triggering taxes or early withdrawal penalties. A QDRO must meet the specific requirements of the retirement plan — requirements that vary by plan — to be accepted by the plan administrator. We note retirement account division in the marital settlement agreement and provide general guidance on QDROs, but we do not prepare QDROs themselves as they require specific information from the retirement plan and specialized preparation.
What should a parenting plan include for holidays?
A comprehensive holiday schedule addresses: major federal holidays, school breaks (spring break, summer break, winter break), each parent's birthday, the children's birthdays, Mother's Day, Father's Day, and any holidays important to your family's culture or religion. The schedule should specify where children spend each holiday, the exchange time and location, and whether the schedule alternates year to year or is fixed. The more specific the holiday schedule, the fewer disputes arise about it.
Is a prenuptial agreement enforceable?
Prenuptial agreements are generally enforceable if they were: entered into voluntarily by both parties (not under duress), supported by full and fair financial disclosure from both parties, not procedurally unconscionable (each party had adequate time and opportunity to review and, ideally, consult with their own counsel), and not substantively unconscionable at the time of enforcement. Courts will not enforce prenuptial provisions that attempt to waive child support rights or that were clearly the product of fraud or coercion. For best enforceability, we recommend that each party have the opportunity to review the agreement with their own independent counsel before signing.
