Real Estate Document Preparation
Professionally prepared real estate documents — deeds, purchase agreements, lease agreements, and property transfer documents — structured to reflect the terms of your transaction and satisfy recording and legal requirements.
Real Estate Law Education
Real estate transactions involve some of the largest financial commitments most people ever make. The documents that govern those transactions — deeds, purchase agreements, lease agreements, and title-related instruments — must be precise, properly formatted, and legally sufficient to accomplish their purpose. A deed that is incorrectly drafted can fail to transfer title. A purchase agreement that is missing key provisions can expose buyer or seller to significant risk.
Real property law is governed primarily by state law, and requirements vary significantly from state to state. The form of deed used, the recording requirements, the disclosures required in a residential purchase transaction, and the landlord-tenant rights established by a lease all depend on the jurisdiction where the property is located. Documents that do not comply with applicable state requirements may be rejected for recording, unenforceable, or ineffective.
For sale by owner (FSBO) transactions — where buyers and sellers transact directly without real estate agents — professional document preparation is particularly important. Without an agent's transaction management, the parties must ensure that their purchase agreement addresses all material terms, that contingencies are properly structured, and that closing documents are prepared correctly.
The Juris Institute prepares real estate documents based on the transaction terms and property information you provide. We research applicable state requirements and format documents for your jurisdiction. We do not provide title insurance, conduct title searches, or act as closing agents — those functions require licensed title professionals.
The type of deed used in a property transfer determines the warranties the grantor is making about the title. A general warranty deed provides the broadest protection to the buyer, warranting title against all claims from any period. A special warranty deed warrants title only against claims arising during the grantor's ownership. A quitclaim deed transfers whatever interest the grantor has with no warranties at all — used commonly in transfers between family members, divorce settlements, and trust transfers. We prepare all deed types and advise which is typically used for your type of transaction.
A residential or commercial lease agreement is a multi-year contract that defines the rights and obligations of landlord and tenant. Lease agreements that are too short leave critical issues undefined — maintenance responsibilities, pet policies, early termination, security deposit procedures, and renewal terms. A properly drafted lease anticipates the disputes that arise over the course of a tenancy and provides clear answers to them. We prepare lease agreements that comply with your state's landlord-tenant statutes.

Anyone transferring, buying, selling, or leasing real property needs properly prepared documents — whether working with an agent, going FSBO, or managing their own investment portfolio.
Homeowners selling without an agent save commission but must ensure their transaction documents are professionally prepared. A purchase agreement that is missing key terms or disclosures exposes the seller to post-closing liability. We prepare complete FSBO document packages.
Investors who buy, hold, and lease multiple properties need lease agreements, assignment documents, purchase contracts, and deed work done efficiently and correctly. Flat-fee document preparation is a cost-effective solution for investors handling multiple transactions.
Every landlord-tenant relationship begins with a lease agreement and requires ongoing documentation throughout the tenancy. Professionally prepared leases that comply with state law reduce disputes and protect the landlord's rights throughout the tenancy.
Transfers of property between family members — parents to children, into a trust, among siblings — require properly prepared and recorded deeds. A transfer that is not properly documented can create title problems that are expensive to resolve later.
Court orders in divorce proceedings often require one spouse to transfer real property to the other. That transfer requires a properly prepared deed, formatted for recording and consistent with the court's order. We prepare divorce-related property transfer deeds.
Buyers purchasing directly from a seller without an agent must ensure the purchase agreement protects their interests — inspection contingencies, financing contingencies, title contingencies, and clear remedies for seller default. We prepare buyer-side FSBO documents.

Common Questions
What is the difference between a quitclaim deed and a warranty deed?
A quitclaim deed transfers whatever interest the grantor has in the property — with no warranties about the quality of that title. If the grantor has good title, the grantee receives good title; if the grantor has a defective title, that defect transfers too. Quitclaim deeds are commonly used for transfers between family members, transfers into or out of trusts, and divorce-related transfers where the parties are not making title warranties to each other. A warranty deed (general or special) includes the grantor's guarantee that the title is free of certain defects. A general warranty deed covers all claims from any period; a special warranty deed covers only claims arising during the grantor's ownership. The type of deed used in a sale transaction is often dictated by custom in your state or county.
Do I need a lawyer to transfer real estate?
In most states, you do not need a licensed attorney to prepare a deed or a purchase agreement — but the documents must be correctly prepared to accomplish your goal. A deed that is incorrectly formatted, missing required information, or not properly acknowledged cannot be recorded. An unrecorded deed can create serious title problems. We prepare real estate documents based on your specific facts and jurisdiction's recording requirements, ensuring the documents are properly structured and ready to execute and record.
What disclosures are required in a home sale?
Required disclosures in residential home sales vary significantly by state. Most states require sellers to disclose known material defects in the property. Federal law requires disclosure of known lead-based paint in homes built before 1978. Some states require additional disclosures regarding flood zones, zoning, homeowner association rules, and specific environmental conditions. We research the disclosure requirements for your state and prepare the required disclosure documents as part of your transaction package.
What should a residential lease agreement include?
A complete residential lease agreement should address: the names of all tenants and the landlord, the property address, the lease term and rent amount, due date and grace period, late fees, security deposit amount and conditions for return, the landlord's entry rights, maintenance responsibilities of landlord and tenant, pet policy, smoking policy, parking, subletting restrictions, early termination provisions, renewal terms, and the specific notices required by your state's landlord-tenant law. Many states also require specific language to be included in residential leases — particularly regarding security deposits — or the landlord forfeits certain rights.
What is a Lady Bird deed and should I use one?
A Lady Bird deed (also called an enhanced life estate deed or transfer-on-death deed) allows a property owner to transfer real property to named beneficiaries automatically upon death, while retaining full control of the property during their lifetime — including the right to sell, mortgage, or revoke the transfer. Lady Bird deeds are available in a limited number of states. They are commonly used as an alternative to passing real property through probate and can help preserve Medicaid eligibility in some circumstances. We prepare Lady Bird deeds in states where they are recognized. Whether a Lady Bird deed is appropriate for your situation is a question that depends on your estate planning goals and we recommend discussing with an estate planning professional.
